Terms of Service

1. Scope

These Terms of Service apply to all orders that consumers place via the online shop liffeyzarchive on Shopify.

We deliver within Germany as well as internationally to Switzerland, the United Kingdom, the USA and to further countries outside the European Union that we offer in the checkout process.

Deviating terms of the customer are not recognised unless we have expressly agreed to their application.

3. Subject of the contract

The subject of the contract is the sale of original vintage, pre-owned and second-hand bags and, where applicable, other used fashion items via our online shop.

The items offered are predominantly already used and in some cases older unique pieces.

4. Authenticity of the items

All branded items we offer are originals. We do not sell counterfeits, replicas or imitations.

The authenticity of the branded items offered is checked by us before sale to the best of our knowledge and on the basis of suitable characteristics.

Brand names, logos and other protected signs are used solely to identify and describe the respective original products.

liffeyzarchive is generally not in a business relationship with the respective brand manufacturers, unless this is expressly stated.

5. Condition of the items

Our vintage and pre-owned items are used unique pieces and may therefore show signs of wear due to age and use.

The respective condition of the item is presented as accurately as possible in the product description and by means of the product photos.

Depending on the item, the following characteristics may be present, for example:

slight scratches or abrasion
discolouration or changes in colour
patina
signs of use
wear on corners, edges, handles or hardware
age-related changes to the material
minor irregularities in the material
other typical traces of previous use

Such characteristics do not constitute a defect if they are stated in the product description, visible in the product photos or to be expected given the age and condition of the used item.

Significant or unusual signs of wear are, where possible, expressly stated in the respective product description.

6. Product description and product photos

We endeavour to describe all items as accurately and truthfully as possible.

The product photos serve to present the respective item and its condition.

As vintage and pre-owned items are often unique pieces, there may be slight differences between the on-screen presentation and the item actually delivered, in particular due to different screen settings and lighting conditions.

7. Conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer.

By completing the order process, the customer submits a binding offer to purchase the items in the cart.

The contract is concluded as soon as we accept the order by an express order confirmation by email or by shipping the goods.

Should an ordered item unexpectedly be unavailable, we will inform the customer without delay and refund any payment already made.

8. Prices, shipping costs, customs and other charges

All prices stated in the online shop are final prices.

Pursuant to section 19 of the German VAT Act (UStG), no VAT is shown.

In addition to the purchase price, shipping costs apply. The respective shipping costs are shown to the customer in the checkout process before the order is completed.

For deliveries outside Germany, depending on the destination country, customs duties, import charges, import VAT, local taxes, handling fees of the shipping provider or other costs arising from the import of the goods may apply in addition to the purchase price.

These costs are not borne by liffeyzarchive and must be paid by the customer where legally permitted.

liffeyzarchive has no influence on the amount or collection of such charges and cannot give binding information on the costs arising in the respective destination country.

The customer is responsible for informing themselves before ordering about possible import charges, taxes and other costs in their destination country.

9. Delivery

We deliver within Germany and to the international shipping destinations offered in the online shop outside the European Union.

Germany: Delivery time is generally 1–3 working days from receipt of payment.

International deliveries: Delivery time may vary depending on the destination country, shipping provider and in particular due to customs clearance.

The expected delivery time is shown in the checkout process where possible.

Delays caused by shipping providers, customs authorities or other circumstances beyond our control may extend the delivery time accordingly.

10. Payment methods

The payment methods offered in the checkout process are available in the online shop.

These may include in particular:

There is no entitlement to use a particular payment method.

11. Retention of title

The goods remain our property until the purchase price has been paid in full.

12. Statutory right of withdrawal

Consumers generally have a statutory right of withdrawal for distance contracts.

For consumers with a delivery address in Germany, the statutory withdrawal period is generally 14 days.

The right of withdrawal generally also applies to used, vintage and pre-owned items.

Details of the right of withdrawal, the start of the withdrawal period, how to exercise withdrawal and the effects of withdrawal are set out in our separate withdrawal information.

Statutory exceptions from the right of withdrawal remain unaffected.

For orders from Switzerland, the United Kingdom, the USA and other countries outside the European Union, the applicable statutory provisions of the country concerned apply.

13. Return shipping costs

In the event of a valid withdrawal, the customer bears the direct costs of returning the goods, provided we have informed them of this properly and nothing else is required by law.

This applies regardless of whether the return is made within Germany or from abroad, where this is permitted under the applicable law.

For international returns, additional customs, import, handling or other charges may arise. These costs are not borne by liffeyzarchive and must be paid by the customer insofar as they arise from the return and are legally permitted.

14. Refund after withdrawal

In the event of a valid withdrawal, we refund the payments received from the customer in accordance with the statutory provisions.

The costs of the original standard delivery are refunded in accordance with the statutory provisions. Additional costs arising because the customer chose a type of delivery other than the least expensive standard delivery offered by us are not refunded.

For the refund we generally use the same means of payment that the customer used for the original payment.

We may withhold the refund until we have received the goods back or the customer has supplied evidence of having sent back the goods, whichever is the earlier.

15. Handling of the goods in the event of withdrawal

The customer may inspect the goods within the scope of the statutory right of withdrawal.

The customer is only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods, and where the statutory requirements for compensation for diminished value are met.

For vintage and pre-owned items, particular care must be taken that no additional damage, soiling or signs of use arise after receipt of the goods.

16. Rights in the event of defects

The statutory rights in the event of defects apply.

Age- and use-related signs of wear that are stated in the product description, visible in the product photos or to be expected given the described condition of the item do not constitute a defect.

This does not apply to defects that were not stated or visible accordingly at the time the contract was concluded.

The customer’s statutory rights in respect of an actual defect remain unaffected.

17. Unique pieces

Our vintage and pre-owned items are often unique pieces.

There is therefore generally no entitlement to exchange for an identical item, unless there is a statutory claim to subsequent performance or replacement.

18. Liability

We are liable without limitation for damage arising from injury to life, body or health and for damage based on intentional or grossly negligent conduct.

In the event of slightly negligent breach of essential contractual duties, we are liable only for the foreseeable, typical damage.

Liability under mandatory statutory provisions remains unaffected.

19. Data protection

Information on the processing of personal data can be found in our separate privacy policy.

20. Copyright

All content of our online shop, in particular texts, photographs, graphics, logos, designs and other content, is protected by copyright.

Reproduction, adaptation, distribution or other use of this content without our prior consent is not permitted, unless such use is allowed by law.

21. Applicable law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

In relation to consumers, this choice of law applies only insofar as it does not deprive the consumer of the protection afforded by mandatory statutory provisions of the state in which the consumer has their habitual residence, where such provisions apply.
